  1. Generally
    This policy explains how and why Unanimous A.I., Inc. ("Unanimous", "we", "our", or "us") collects, uses, and shares information about you when you access and use our Swarm.ai website and services, including, without limitation, mobile applications, rooms and Swarm® Sessions (collectively, the "Services") or when you otherwise interact with us. This Privacy and Data Policy applies to all of the Services.
  2. Information You Provide to Us
    We collect information you provide directly to us when you use our Services. This includes, without limitation:
    1. Information Regarding Your Use of the Services
      We collect the content and other information you provide when you use our Services, including the choices you make when you participate in Swarm Sessions. This may also include includes information used to create your account (e.g., a username, password and in some cases, an email address), account preferences, the content of communications between you and other users of the Services, and, in certain cases, the content of information you post to the Services (e.g., text, photos, videos, links).
    2. Other Information
      You may be required to provide other information directly to us in order to participate in certain elements of the Services. For example, we may collect information when you fill out a form, participate in a Swarm Session, visit a room, answer Swarm Session-participant questionnaires, communicate with other users, communicate with us via third-party sites and services, request customer support or otherwise communicate with us. Some of this information, such as zip code, interests and gender, may be added to your profile. Some of this information may be necessary to qualify you to participate in certain elements of the Services.
  3. Information We Collect Automatically
    When you access or use our Services, we may also automatically collect information about you. This includes, without limitation:
    1. Log and Usage Data
      We may log information when you access and use the Services. This may include your IP address, browser type, operating system, referral URLs, device information (e.g., device IDs), pages visited, links clicked, user interactions, including Swarm Session data, the requested URL, hardware settings, and search terms.
    2. Information Collected from Cookies
      We may receive information from cookies, which are pieces of data your browser stores and sends back to us when making requests. We use this information to improve your experience, understand user activity, personalize content and advertisements, and improve the quality of our Services. For more information on how you can disable cookies, please see "Your Choices" below.
    3. Location Information
      We may collect information about the location of your log-in, including, without limitation, by using IP address.
  4. Social Sharing
    In certain cases, we may offer social sharing features or other integrated tools that let you share content or actions you take on our Services with other media. In such cases, your use of these features enables the sharing of certain information with your friends or the public, depending on the settings you establish with the third party that provides the social sharing feature. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the third parties that provide these social sharing features (e.g., Reddit, Facebook, and Twitter).
  5. How We Use Information About You
    We use information about you to:
    1. Produce and deliver services and reports to third parties who have engaged us to conduct market research and/or provide decision-making advice (which may identify certain demographic characteristics, but never identifies any individuals);
    2. Provide, maintain, and improve the Services;
    3. Help protect the safety of the Services and our users, which includes blocking suspected spammers, addressing abuse, and enforcing the Swarm.ai user agreement;
    4. Send you technical notices, updates, security alerts, invoices and other support and administrative messages;
    5. Provide customer service;
    6. Communicate with you about products, services, offers, promotions, and events, and provide other news and information we think will be of interest to you (for information about how to opt out of these communications, see "Your Choices" below);
    7. Monitor and analyze trends, usage, efficacy, and activities in connection with our Services (without identifying any individuals); and
    8. Provide information and/or offers to users who we believe may have an interest in a particular topic based on their activity using the Services.
  6. How We Share Information
    When you use the Services, certain information may be shared with other users, our clients, and the public. For example:
    1. We may share aggregated or de-identified information obtained from you. This information cannot reasonably be used to identify you unless, you have used your personal information in your profile, e.g. your username is your real name. In most cases, we share this information with a specific company that has engaged us to do market research or optimized decision-making on its behalf. In certain cases, we may also share this information with organizations such as corporations, universities, and market research firms that may analyze the information for trends and insights. In other cases, we may use this information to conduct polls and/or contests.
    2. When other users view your profile, they will be able to see information about your activities on the Services, such as your username, questions you have asked or participated in, moderator status, status on the Services, and other details. Some of these details you may choose to hide or display by editing your profile.
    3. Please note that, even when your account is deleted, the posts, comments, participation in Swarm Sessions, answers to market research questions and communications you submitted prior to deleting your account will be anonymized but may still be visible to others, and you may not be able to delete such content after you post it. We may also retain and utilize certain information about you and your activity using our Services as required by law or for legitimate business purposes after you delete your account. For more information, see "Your Choices" below.
    4. If you submit a question, post or comment to the Services, other participants in the Swarm Sessions as well as system administrators will be able to see the content of your questions, posts and comments, the username associated with your questions, posts or comments, and the date and time you originally submitted the question, post or comment.
    5. We will not share, sell, or give away any of our users’ phone numbers, real names, e-mail addresses, or physical addresses to third parties, unless one of the following circumstances applies:
      1. We may share information with vendors, consultants, and other service providers who need access to such information to carry out work for us (for example, in connection with a contest or promotion);
      2. If you participate in contests, sweepstakes, promotions, special offers, or other events or activities in connection with our Services, we may share information with entities that partner with us to provide these offerings;
      3. We may share information (and will attempt to provide you with prior notice, to the extent legally permissible) in response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, regulation, legal process or governmental request, including, but not limited to, meeting national security or law enforcement requirements;
      4. We may share information in response to an emergency if we believe it's necessary to prevent imminent and serious bodily harm to a person;
      5. We may share information if we believe your actions are inconsistent with our user agreements, rules, or spolicies, or to protect the rights, property, and safety of ourselves and others;
      6. We may share information between and among Unanimous, and its current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and
      7. We may share information with your consent or at your direction.
  7. Sponsored Rooms and Analytics Partners
    We may partner with sponsors of rooms, and analytics partners to deliver offers and content targeted to your interests and to better understand your use of the Services. These third parties may collect information sent by your computer, browser, or mobile device in response to a request for content, such as unique identifiers, your IP address, or other information about your computer or device. For example:
    1. Sponsored Rooms
      Sponsors of our rooms may use cookies and use related technologies to collect information when ads are delivered to you on our Services. Unanimous may provide data about you, browsing habits, Swarm Session choices, answers to market research questions and other data to such third parties.
    2. Analytics Partners
      We use analytics partners (such as Google Analytics) to help analyze usage and traffic for our Services. As an example, we may use analytics partners to analyze and measure, in the aggregate, the number of unique visitors to our Services.

  8. Security
    We take reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration, and destruction. We use service providers such as Amazon cloud for data storage. Any vendor that we retain are not allowed to use information they receive from us for any other purpose that to perform the services we have contracted them to perform. Such vendors will never barter, trade, or sell access to your information. 
  9. Children under 16
    The Services are not intended or directed at individuals under the age of 16. Therefore, individuals under the age of 16 may not create an account or otherwise access or use the Services.
  10. Your Choices
    As a user of the Services, you have choices about how to protect and limit the collection, use, and disclosure of, information about you. This includes:
    1. Preferences
      We may provide you with tools and/or preference settings that allow you to access, correct, delete, and modify information associated with your account.
    2. Account Information
      You may delete your account at any time by sending an email to [email protected]. When your account is deleted, certain personal information you have provided is no longer visible to other users and disassociated from content you posted under that account. Please note, however, that your de-identified profile and the posts, comments, participation in Swarm Sessions, answers to market research questions and messages you submitted prior to deleting your account may still be visible, and you may not be able to delete such content after you post it. We may also retain and utilize certain information about you and your activity using our Services as required by law or for legitimate business purposes after you delete your account.
    3. Cookies
      Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject first- and third-party cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.
    4. Promotional Communications
      You may opt out of receiving promotional communications from us by following the instructions in those communications. If you opt out, we may still send you non-promotional communications, such as information about your account or your use of our Services
  11. Your Rights.
    1. You have the right to access the Personal Information that we hold about you and to correct, update, amend, suppress, delete or otherwise modify any Personal Information where it is inaccurate. When updating your Personal Information, we may ask you to verify your identity before we can act upon your request.
      By "Personal Information," we refer to information that you individually provide to Us either directly or indirectly that on its own or in combination with other information, can be used to identify you or make you identifiable. Personal Information includes for example your name, your mailing address, your telephone number, your email-address or other information that identifies you or makes you identifiable.
      Information that by itself cannot be used to identify you or make you identifiable does not qualify as Personal Information.
    2. You may also, if governed by the General Data Protection Regulations, object to the use or processing of your Personal Information or withdraw consent to use your Personal Information at any time.
    3. Under the General Data Protection Regulations, regarding the processing of your Personal Information, you have the following rights:
      1. the right to request free of charge (i) information whether your Personal Information is retained and (ii) access to and/or (iii) duplicates of the Personal Information retained. However, if the request affects the rights and freedoms of others or is manifestly unfounded or excessive, we reserve the right to charge a reasonable fee (taking into account the administrative costs of providing the information or communication or taking the action requested) or refuse to act on the request;
      2. the right to request proper rectification, removal or restriction of your Personal Information;
      3. where processing of your Personal Information is either based on your consent and processing is carried out by automated means, the right to receive the Personal Information concerning you in a structured, commonly used and machine-readable format or to have your Personal Information transmitted directly to another company, where technically feasible (data portability);
      4. where the processing of your Personal Information is based on your consent, the right to withdraw your consent at any time without impact to data processing activities that have taken place before such withdrawal or to any other existing legal justification of the processing activity in question;
      5. the right not to be subject to decisions based solely on automated processing that produces legal effects concerning you; and
      6. the right to take legal actions in relation to any breach of your rights regarding the processing of the Personal Information, as well as to lodge complaints before the competent data protection regulators.
